Lawyers employed “in-house” in a corporate capacity are subject to an increasing number of malpractice claims. Do not assume you are immune from a claim, however, simply because you are a corporate general counsel or are practicing within the legal department of a non-legal corporation. Also, do not assume that your employer's existing liability insurance covers you as an attorney!

As more companies hire in-house counsel to perform services that have traditionally been delegated to outside law firms, corporate attorneys face increasing professional liability exposures. This is particularly true with respect to third parties or even the company’s own employees who may bring a cause of action against in-house counsel.

Almost all commercial general liability policies specifically exclude coverage for professional liability claims. Even corporate directors & officers (D&O) policies provide coverage for an attorney only within his or her role as a director or an officer.

When properly designed, an Employed Lawyers Professional Liability Insurance policy addresses the unique risks in-house attorneys face. These can include coverage for:

  • Claims by non-client third parties.
  • Claims for SEC and regulatory claims.
  • Claims for Employment practices liability (EPL) claims by co-workers for discrimination, wrongful termination, harassment, or retaliation which arise out of the attorney's legal work for the company.
  • Claims for claims by individual employees that the in-house attorney is assigned to represent.
  • Claims brought by the employer, the board of directors, and its officers.
  • Coverage for employer-approved pro-bono representations.
