Solo Practitioners to 10 Attorneys

Smaller law firms, from solo practitioners to about 10 attorneys, have unique needs when selecting their legal malpractice insurance provider. While some smaller firms are truly general practices, covering a variety of legal issues, others are highly specialized and thus can present special challenges to insurers.

Some insurance carriers won’t insure small firms. Here are a few reasons:

  • The premium size does not, in some underwriters’ opinions, justify the amount of effort it takes to underwrite the risk.
  • Especially with solo practitioners, carriers fear that the firm will accept more cases than the attorney(s) can handle. If the attorney is involved in a lengthy trial, who will respond to other pending matters?
  • If business is slow, there is concern that the attorney(s) will accept a case outside their area of expertise.
  • Docketing errors and administration problems of small firms lead to more claims than substantive errors of law.
